General Terms and Conditions of Sale

1. Purpose and Scope of Application
These General Terms and Conditions of Sale (hereinafter, “Terms”) govern the booking and purchase of services offered through the chiacchiopropertymanagement.kross.travel website (hereinafter, “Site”).
By using the Site to book a service, the Client agrees to these Terms.
The booking service concerns the management of tourist facilities and accommodations offered by the provider Chiacchio Property Management.

2. Definitions
For the purposes of these Conditions, the following definitions shall apply:
- Provider: Chiacchio Property Management, operator of the online reservation system.
- Customer: The user who uses the Site to book a facility or service.
- Facility: The accommodation or property available for booking through the Site.
- Reservation: The act by which the Client agrees to purchase a service or stay at a facility.

3. Reservation Procedure
3.1. Registration and Personal Data
To make a reservation, the Client must fill out the reservation form on the Site with his/her required personal data (first name, last name, address, email, etc.). The Client agrees to provide true, accurate and complete information.
3.2. Availability and Prices
Prices and availability of facilities are updated in real time and displayed on the Site at the time of booking. However, availability is not guaranteed until the time of booking confirmation.
3.3. Confirmation of Reservation
The reservation is considered confirmed only upon receipt of a confirmation email, which will be automatically sent by the system after payment (if applicable) or validation of the reservation.
3.4 Errors and Omissions.
In case of obvious errors in prices or information regarding the facilities, the Provider reserves the right to cancel the reservation, promptly notifying the Client and proposing an alternative solution.

4. Prices and Payments
4.1. Prices
The prices displayed on the Site are inclusive of VAT, unless otherwise stated. Any additional costs (local taxes, service charges, etc.) will be shown before the final confirmation of the booking.
4.2. Payment Methods
Payment for the stay may be requested in various methods, including:
• Credit or debit card
• Bank transfer
• Other electronic methods specified at the time of booking.
Payment must be completed within the time frame indicated on the Site. In case of non-payment, the booking will be cancelled.
4.3. Guarantee Card
For bookings where no advance payment is required, the Customer must provide credit card details as a guarantee for the booking. For bookings with a check-in scheduled more than 30 days in advance, the Supplier reserves the right to perform a pre-authorization on the provided card as a security measure to ensure the validity of the booking. The pre-authorization does not involve an immediate charge but will be used as a guarantee for any damages or changes to the itinerary.
4.4. Payment Security
The Supplier ensures the security of payments made through the Site, using secure payment systems compliant with international data protection standards.

5. Cancellation, Modification and Refund Policies.
5.1. Cancellation Policies.
Cancellation policies are specific to each facility and are visible at the time of booking. These policies establish the time limit within which the Client may cancel the reservation without penalty.
5.2. Late Cancellation Penalties.
If the Client cancels the reservation after the deadline, the Provider reserves the right to retain a percentage of the total amount as a penalty. The amount of the penalty shall be clearly stated prior to the confirmation of the reservation.
5.3 No-show.
In case of Client's no-show without prior notice or cancellation, the Supplier reserves the right to charge the full amount of the stay.
5.4 Modification of Reservation.
Changes to the reservation (e.g., change of dates) must be made with the consent of the facility, which may apply additional charges or limitations depending on availability.
5.5. Refund
In case of cancellation in accordance with the cancellation policies, refund, if due, will be processed as soon as possible and no later than 14 business days from the date of cancellation.

6. Responsibilities
6.1. Supplier's Responsibilities.
The Provider undertakes to ensure the proper functioning of the Site and payment systems. However, it is not responsible for service interruptions, technical errors or malfunctions.
6.2. Liability of the Facility
The Provider is not responsible for problems, damages, or inefficiencies related to the booked facility, which are the sole responsibility of the facility manager.
6.3. Force Majeure
The Supplier shall not be held liable for failure to fulfill obligations resulting from force majeure (e.g., natural events, pandemics, strikes, etc.).

7. Privacy and Data Protection.
7.1. Processing of Personal Data
The processing of personal data is carried out in accordance with the EU Regulation 2016/679 (GDPR). The Customer's data will be used exclusively for the management of the reservation and will not be transferred to third parties without the user's consent, except as necessary for the execution of the reservation.
7.2. Rights of the Interested Party
The Customer has the right to access, correct or delete his/her personal data at any time, as well as to exercise other rights under the GDPR. For more details, the Client is invited to consult the Privacy Policy.

8. Changes to the Conditions
The Provider reserves the right to change these Conditions at any time. Changes will be posted on the Site and become effective from the date of posting. It is the Customer's responsibility to consult the Conditions regularly.

9. Disputes and Jurisdiction
9.1. Applicable Law.
These Conditions are governed by Italian law.
9.2 Jurisdiction.
For any dispute arising out of the use of the Site or the booking of a facility, the place of jurisdiction shall be exclusively that of the city of [insert Supplier's registered office].

10. Acceptance of the Conditions
By making a reservation on the Site, the Customer confirms that he or she has read, understands, and fully accepts these Terms and Conditions.
